Generadora y Comercializadora de Energía del Caribe – GECELCA mixed private-public utilities company subject to the procurement legal regime provided in Act 142 of 1994, meaning that its acts and contracts are governed by private law (Judgment C-736 of 2007).
Accordingly, the procurement regime applicable to the company is private law and is not subject to the state procurement regime provided in Acts 80 of 1993 and 1150 of 2007; therefore, it has its own Procurement Rules and Regulations, which conform to the principles of the administrative duty and fiscal management as provided in Articles 209 and 267 of the Political Constitution.
